I have an employeer that mailed me a check, but to the wrong address. Now here it is a week later, and he still wont give me my check. He tells me that if i want my check i will have to wait untill he gets it back in the mail, or pay $30.00 for cancling the check if i want it. How is this legal, and what can be done

Re: Paycheck

In Florida, there is no set rule as to the payment of the last check. Standard practice and procedure is that it is to be given on the next regular payday. As to the $30, it does not seem correct for the employer to require you to be financially responsible for the error.

You can give your employer written notice that you have not received your final earnings and demand that it be delivered. After your employer has received this in writing, the employer has 15 days to furnish you the paycheck.

Good luck on this matter.
