Pension Payout

In 1996, I retured from a small medical office and received a apyaout from its pension/profit-sharing plan. An employee who left after me was fraudulently shortchanged on her payout but was able to recovere the additional money owed to her. Is there a stature of limitations on such matters? If not, could you suggest a possible next step for me to investigate my options?

I believe (but am not certain) that the longest statute of limitations for pension matters is 6 years. Even if that is the case, you can still do two things. First, contact the US Dept. of Labor and ask for technical assistance with a pension matter. The operator will connect you to the correct department. Explain the matter and see what they suggest regarding the limitations and any other steps you can take.

Second, you can still make a demand of the company, regardless of the limitations. Who knows, perhaps they want to correct the mistake. Explain the issue in a letter to them, let them know why you think you were paid incorrectly, and let them know it is the same situation as the other employee if that is true. Don't be accusatory or belligerent. Just state the facts and ask for whatever compensation it is that you think you are owed. The worst they can say is no.
