Legal Question in Employment Law in Florida

Performance and Salary

Two years ago I was moved to a position with a lower salary grade than the salary I have. I accepted the position because I got a letter from HR stating that I still will get increases on good performance. This year I got a good review but no increase. I want to leave but I don't want to lose my severance package (22 years and 1 week per year worked). What can I do?

Re: Performance and Salary

Under Florida law there is no right to a severance package unless you have a legally binding contract which gives you that entitlement. On the other hand, if it has been company practice to provide a severance package and they are not doing so in your case, it may be an issue of discrimination. It all depends on the specific facts of your case.

You should seek a consultation with an employment discrimation attorney. To find one go to www.nela.org.
