Legal Question in Employment Law in Florida
Pomise of Employment
I am 56 years old and was employed by a furniture company until November 9, 2005. I was let go because hurricane Wilma dameged the building beyong repair. Prior to my letter of release I was told a new location was in the near future and that I would be rehired as soon as it was ready.I kept in contact with my employer with several phone conversation and one time by visiting the new store while under construction.Several weeks have now pasted and each time i talked to my employer I was told the same thing that I would be rehired as soon as the store was ready. My last phone call came four days before the new store opening I was told by the operational manager that someone else was hired and that he did not have a answer for me as to why. I did not seek other employment because of a verbal primise. Do I have a case against my former employer?

Re: Pomise of Employment
In Florida, the type of promise that you have explained is not a basis upon which to try and bind your former employer (unfortunately). It is, in the end, just words that Florida Courts would not view as creating a contractual or other obligation. However, if you have not already, you should file for unemployment benefits ASAP and date your claim back to the last time you worked and received wages.
