Legal Question in Employment Law in Florida

Presented with Non-Compete After 2 Years

I've been employed with a company for 2 years. I signed a Confidentiality Agreement upon hire. Now, 2 years later, I am presented with a Non-Compete and it's being requested that I sign it or leave.

What are my rights in this situation and is this normal procedure?

You can sign or you can quit. Check the terms of your present contract regarding the terms of contract termination. You may be "better" letting them terminate your contract as opposed to you quitting (that would be you terminating the contract).

Re: Presented with Non-Compete After 2 Years

An employer may present a non-compete at any time. If you don't sign, it you may be terminated. However, read it carefully. If its severely hampers your ability to work in the event you are later fired, you may want to consider just looking for another job. Some agreements go beyond what the law permits so you may want to have the proposed agreement reviewed by an attorney. If you would like a consultation, please feel free to contact my office.
