Problem with Hiring Manager. . . Can I do anything?
I don't know if I can go anywhere with this problem, but here is the situation at work. My boyfriend and I work for the same company & currently there is an opening on his ''Team'' in Customer Service. I'm very interested in this position because it is a stepping stone into other jobs towards our IT department.
Well, the problem is that his manager has made it very clear to me and to my boss that as long as my boyfriend is on her team then she would not consider me for the position. She has spoken to our HR department and was told we have no policy to cover this so the decision would be left up to her. Well, she has decided that I can't be on the team when I have as many qualifications & experience as anyone else she has chosen or interviewed. She sites that I have no ''call center'' experience and that is why she is not considering me, but it only states it is preferred. She has hired people with no ''call center'' experience, the last person she choose for this position did not have any. I have the technical knowledge and customer service skills she is looking for but she always goes back to the ''call center'' reason.
Can she take this position? Does it fall under marital status discrimination? Do I have any recourse?

No this does not fall under the Florida Civil Rights Act's "marital status" protections and no, unfortunately, you do not have any legal recourse for this decision. It is ultimately a business decision which, while unfair to you, is not illegal.
