Legal Question in Employment Law in Florida

PTO pulled while on vacation

My mother recently took a two week long vacation, after having saved up all of her PTO. WHILE she was gone, the company changed their policy and decided to stop giving employees PTO. When she came back she was told about the new policy and told that the vacation she was already on in the middle of this change, will not be covered. So now she wont be getting a paycheck at all for that pay period. Is there any federal or state law that protects her from this? I is there something she can sight win arguing this with the big wigs?

Re: PTO pulled while on vacation

Unfortunately, Florida law does not require private employers to provide vacation or PTO...but a letter to someone in management playing upon the unfairness of the situation might lead to some change for her specific situation. If not, she may consider whether her future employment prospects are elsewhere, because while this practice is not illegal, its not a good way to treat employees. Your mother may want to consider if she has any potential claims (such as unpaid overtime wages) which she previously would not have considered pursuing but now could use as leverage since they have misled her (even if not in an illegal way) about their vacation policy.

I believe she has an estoppel claim. If she wants to fight it, she should probably consult with an employment attorney.
