Legal Question in Employment Law in Florida
I was recently terminated after 10 years, for walking into the men restroom, while a female cleaning lady was in the men restroom, cleaning and talking to another male staff. I walk by her and proceeded to the urinal, unbuckled my belt and turn to see if she had left. As I did that, she began to tell me how rude I was and departed. Eventfully reporting my actions to HR. I was terminated, however they were not clear as to why they were terminating me. When I asked for what, I was advised that my action was in the line of indecent exposure. After advising them that I didn't expose my genitals to her and I didn't urinate until she left, I was still terminated. Do I have any grounds to back to obtain my job back. I am African American, the cleaning lady is Trinidadian-Tobago native, and the other individual in the rest room is Caucasian. Additionally another employee was recently caught on video surveillance defecating in the landscape bushes and numerous complaints over the course of several weeks, and after catching him on video surveillance he was only given written warning, and told to clean his mess up.
