Legal Question in Employment Law in Florida

Reduction of Pay rate after quitting

My ex-employer reduced my pay rate to minimum wage, on the final check I recieved after I quit. Is this legal, even though when I worked it was for regular pay and they did not notify or tell me that my rate would be reduced if and when I quit.

Re: Reduction of Pay rate after quitting

That would be a breach of contract (the contract is the fact that you agreed to work for a particular rate of pay) unless you agreed that your last pay check would be reduced.

If there is a lot of money at stake, then you could sue. If it is not worth the time adn money to do so, you could call the US DOL, wage and hour division, and ask if they can help. They usually handle overtime matters, but they might be able to assist. The no. is 866.487.9243.

Or, you could hire an attorney to write a demand letter. That would hopefully either get an explanation from the employer or the pay that you are owed if there is no good reason for the deduction.

If you want to review the matter in detail, please call for a free consultation. I might be able to help either for a small retainer fee, or on a contingency basis (no fee unless we collect the money you are owed).

Good luck.
