Restraunt owner takes 60% of our tip earning
I work at a restaurant as a server.
Our employer takes 60% of our tip earning. 50% goes to the chefs and the rest of 10% goes to other staff, like busboys, bartenders, etc. The restaurant has an open kitchen so that the customers can see them cook, but they do not entertain or serve the customers.
The servers are not paid minimum wage, a little over three dollars per hour, including the 2 hours of prep time.
Is what our employer does legal?
