Legal Question in Employment Law in Florida
Retaliation
while closing the shift,I was short 50 dollars;I told my partener that we need to call the manager. he found the money in trash canne, since I had to leave (10 pm)to my second job I didn't call the manager because the other employe told me he would take care of it.The next day the manager called me home and told me that I was suspended untill he talk to his boss but the other employee was not suspended because he believed him since he knew him for years, without even listening to my side of the story.I know I was set up because i know many things about the manager who is dating an employee and giving her up to 16 extra hours a week,I have proofs(schedules sheet and payroll statements)he trained me as his assistant and when I told him that he could get in trouble for that he stoped training me and he hired somebody for that position. He knows for sure that I didn't touch that money and that I don't know how that money ended up in trash cann;he will meet with his TM tomorrow to make a decision. Now what are the legal procedures first for accusing me of stealing without giving me a chance to defend my self and without prooving it; second could he legally fire me for that, appreciate ur help.
Thanks

Re: Retaliation
Unfortunately, there are no legal procedures that govern your situation. In fact, there is no law at all the governs the speciifcs you presented. As a result, your employer can as he or she wishes, meaning that they can legally fire you with or without cause, as Florida is an at-will employment state, meaning that you can be fired a good reason, a bad reason, or no reason at all! Sorry I don't have better news to communicate.
