Legal Question in Employment Law in Florida

Retaliation for Retirement

I have notified my company of 12 years that I am retiring. In retaliation, they are going to demote me to a lower paying position until the time I retire. I believe the E.R.I.S.A. prevents them from firing me, but can they demote me?

Re: Retaliation for Retirement

Your case sounds truly interesting..

at first blush it sounds like a ADA case, based on age discrimination, and the ERISA may also be implicated in their retaliation.

essential first step is to either file your charges with appropriate agencies or obtain counsel to do this for you.

i work on a modified contingency basis, with a very modest free upfront payable in two installments during the first six months.

I seek settlements for my clients through demand letters and mediation.

Email me, giving me full, chronological details of the situation, and I can likely tell you if I can take your case. Include all details of your age, status of employment, name of ee, demographics of you and the person who got your former duties/job.(the "comparator")

sincerely, anne c. terry
