Legal Question in Employment Law in Florida

Scheduling conflicts

For 14 years I have been working for a company who until now has always accomodated me with not scheduling me to work on Sundays as that is the day I attend church and spend time with family. I am a full time employee and this company is open 7 days a week. I work morning hours from 6am to 2:30pm. Recently, they have been scheduling me to work on Sundays knowing I am not available. I have discussed this situation and even provided church information to my immediate supervisor to no avail, they still continue to schedule me on Sundays. I now do not know where to go from here. Can you please advise me on my options?

Re: Scheduling conflicts

The law requires your employer to make some effort to accommodate your religious practices. Still, they do have the right to make you work on Sunday when not do so would cause them an undue hardship. For example, if giving you Sunday off means they have to pay overtime to another employee or a particular shift does not get covered, then that would be a hardship. However, if there are employees who would swap shifts with you and that results in no extra costs to the company, they should allow the change in shifts. One more note, if your workplace has a union then the collective bargaining agreement might control. More information on religous discrimination is available the the EEOC web site, www.eeoc.gov.
