Legal Question in Employment Law in Florida
Severance pay withheld when fired
I worked for a co. for 10 yrs. Married a man that also worked for the same company (but in the sales dept). He left the company and went with a competitor. We were honest and told the president the day he signed on to the new company. A meeting of Mgrs was held and it was decided that it was a conflict of interest to allow me to stay and therefore I had to be terminated immediately. In the past, this co has always given severance pkg to everyone that was let go without fault, as well as in the exactly same situation a couple of yrs ago they gave severance to the spouse that they fired. My severance pkg should have been for 10-12 wks pay. Is the company required to pay me the severance package?

Re: Severance pay withheld when fired
Unless your employer has a formal severance plan (that is either in writing or can otherwise be established), neither Florida nor Federal law require an employer to pay an employee severance.
