Legal Question in Employment Law in Florida

Severance

I worked at a large financial institution for 16+ years and was laid off after my boss was laid off. I received 2wks of severance for the first year I worked and 1 week/yr thereafter. Others I know received 2 wks of pay for each year they worked. HR says they aren't required to pay severance at all so the point concerning amount is moot. They also say they have no written policy on severance but say they based severance on 'years of service'. They say they gave non-exempt employees the amount I got and exempt employees the higher amount (2 wks/yr). How can they administer monies and not have a written policy?

Re: Severance

Regardless of their policy or not, unless you have a written contract or other agreement regarding severence, you are not entitled to receive any, so whatever you receive is more than you are owed -- regardless of what others receive or do not.
