Legal Question in Employment Law in Florida

sex/age discrimination

Im the Dir of Sales/Mktg for a hotel. A memo was just sent to all employees notifying us that the Front Desk Mgr was just promoted to Asst General Mgr. It stated that he was going to help out 2 departments administratively. There was no mention of any of the 3 departments I manage. Yet it did state that in the GMs absence he would be in charge. I answer to the GM therefore would have to answer to him in her absence. This position was not in existence nor was it posted for interviews. In the past, I have made it known to the owner that I was interested in the GM position should it become available. The person placed in this new position has a total of 4 yrs experience in the hotel business (2 1/2 in a management position). I have 24 yrs experience in the business most of which has been in management. Can this be considered sexual or age discrimination even though interviews were not held? I am a 42 year old woman and he is a 25 year old man. I feel this man is being positioned to take the GMs job by giving him the General Management experience with a title as opposed to true experience.

Re: sex/age discrimination

Its certainly possible. You need to consider filing a Charge of Discrimination with the U.S. Equal Employment Opportunity Commission. Please feel free to call me at (305) 810-2887 for further assistance.

Re: sex/age discrimination

The facts and circumstances you have described should be discussed with an attorney. You may have sufficient basis for a potential discrimination; however, companies can promote, fire, etc. without a reason, so long as there is no discrimination involved.

I believe you should contact an employment attorney to further discuss this matter.

Good luck.
