Legal Question in Employment Law in Florida
Sexual and age descrimination
I work in sales for a company and deal with the major accounts across the country. Approx 2 years ago a young female was hired to work with a particular industry segment. One of the owners stated that they felt they needed a young woman with long legs and a short skirt to get in the door. Over the next two years she has failed repeated to produce, in fact losing money while I bring in large profit margins. She is given more of my accounts and more is taken from me. We both have base salaries plus commissions, now I learn that she earns only a small amount less then myself in salary and makes fifty percent more than I do in commission and yet they have set her quotas at half of mine. I am 45 she is approx 26. She continues to fail and yet all the pressure to produce is placed on me. It has become very apparant that she is being protected and given many preferences because of her sex. Do I have any options?

Re: Sexual and age descrimination
You have two potential claims - age and sex discrimination. Honestly, both are difficult to win, and if you begin a battle with the company, you should be prepared to leave. These fights often lead to discharge (whether legal or not) and very bitter feelings which will make you want to leave anyway.
If you want to proceed, you must first pursue an administrative remedy through either the EEOC or a state or local human rights office. You can file a claim for free and do not need an attorney. If you want to hire an attorney to help you, and to negotiate with the employer, be sure to know exactly what it will cost. There is no guarantee that you will get anything in a lawsuit or settlement, so you do not want to throw too much good money after bad.
Feel free to call me as well to discuss the case. I try to take such cases on for a small flat fee and a contingency of any recovery, if the case has merit. In the least, I can point you in the right direction.
Good luck.
