Legal Question in Employment Law in Florida
Shady employment practices
My company has started a new clock-in/out policy that has not been presented to the employees other than in verbal memos by management. If we clock in/out more than 5 minutes early/late, we accrue .5 points. At 6 points (in 6 months time), we are fired. It's a retail company and sometimes we can't stop helping customers but we need to clock out. By earning them money (by continuing to help the customer) , we accrue the points and end up getting fired. Is this legal? Would I have a leg to stand on in court if it came to that?

Sure -- it is legal. Dumb policy, but legal. When you are with a customer and need to clock out, tell the customer that you boss requires you to stop working. You'd like to help, but the boss prevents it. Encourage the customer to call and complainn. Maybe they will change the policy, but they need not do so. It's their business. They get to make the rules -- but that is a dumb one.
