In the state of Florida, can an employer legaly terminate my employment and hold me to a non-compete agreement? I am a Certified Nurse Midwife currently working out a six weeks notice and having great difficulty finding employment in my area of expertise. The agreement in my contract is worded as follows...
"Employee agrees and covenants that for a period of 1 year following the termination of this Agreement, whether such termination is voluntary or involuntary, Employee will not directly or indirectly engage in any business competitive with Employer." Thanks for your help. Tammy Hess

Based on the limited information you present, I believe it would be difficult for your former employer to enforce a non-compete worded the way you describe. You might want to consult personally with an attorney to review the agreement in full and discuss with your options.
