Legal Question in Employment Law in Florida
what is my next step?
the co. i work for has been trying to force me to quit/find grounds for termination for over 6 mos.first, i had a foot problem,& got m.d. letter, stating i had to wear certain shoes, then write up for tardiness by one individual, when all others tardy did not get write-up.finally,i'm put on a personal improvement plan.i am under fmla.finally, one day i was ill,& had problems at home but to avoid absence,i called in late, took my rx for bedtime, rested, and was numb when i arrived.i was sent home w/a driver.the next work day i was drug tested. i tested positive, which was overturned due to it being prescription meds only-proven.my dr. wrote 3 letters to satisfy them. now i'm suspended w/pay,pending an evaluation with drug abuse counselor.they've said i will be drug tested regularly at random times,i advised i need the prescribed medications.i had applied just before the write-up to transfer to sales dept.,but the write-up precluded me for a year. when if i asked this same individual director if it was necessary i sign write-up(it can be fought, otherwise)he said i had ''no choice'',i later found out he lied. i need to protect myself,& be made whole,& recoupe, any & all losses. please advise.
