Legal Question in Employment Law in Florida

suspended in retaliation...

I am employed by a school district. I presented a proposal to the school board, disclosed my employment, offering to take over technical support for local schools. The proposal outlined that I would resign if the board was interested in persuing this service. All work was done from my home after hours without using district resources. I have been suspended with pay pending a misconduct investigation. The district will not disclose what those misconduct charges are. There has been stress between the director of my dept and myself since Oct of last year. He has been riding me pretty hard to the point that I feel I've been harassed.

My proposal was filed on Monday and I was suspended on Friday. I believe that he has done this in retaliation whom should I make my report to and do you feel that I need an attorney? Thanks. Melanie

Re: suspended in retaliation...

Melanie:

There is no legal claim for any "retaliation" under these facts, but before the School Board takes any disciplinary action against you, you are entitled to notice of the intended discipline and depending on the actual discipline, you may have a right to a hearing on it.
