Legal Question in Employment Law in Florida
Does Tittle Seven Apply?
My wife is in a hostile work enviroment. She repeatedly has to go through profanity laced tirades by her supervisor in front of customers and other employees.Today this supervisor went of the deep end and began calling her an f****** bitch in front of customers. She then picked up a knife and threatened to show her how it felt to be backed stabbed. The question is does the comment f****** bitch put gender into the equation, (they are both females) which as I read would make Title Seven apply. If not does she have any options. She is too afraid to go back to work. The supervisor is still employed even though the attack was witnessed by the owner of the store. She and other employees have complained to the owner about this behavior, but nothing has been done.

Re: Does Tittle Seven Apply?
Under the facts you presented, your wife would not have any legal claims under either Title VII of the Civil Rights Act or any other local, state or federal law. While her supervisor's comments may be inappropriate, they are insufficient to constitute a hostile work environment, or other recognized form of discrimination, as a matter of law. Moreover, your wife should be very careful in her behavior, as picking up a knife and directing it (even if only figuratively) towards someone could subject to her possible criminal charges for assault.
