Tuition Reimbursement

My boss wants to offer tuition reimbursement to one employee but not to ALL employees. He wants to pick and choose who he wants to offer this to upon request of the employee. Is this legal? Can he offer this benefit to one employee and not all?

Yes, the employer can decide whether he wants to provide tuition assistance to some or all employees. It may count as income to the employee.
