Legal Question in Employment Law in Florida
Unemployment appeal by employer
I was fired for missing 5 days of work over 2 month period-3 were paid sick days.I filed for unemployment and am receiving it for last 2 months. Company filed appeal and now I have hearing. They have included documents they say prove my absenteeism and there are other documents submitted(non-conformance cost analysis) which have nothing to do with their appeal and none are signed by me. There are also documents that have written dates on them AFTER my firing. The state (Florida) has determined I am eligible because I wasn't fired for misconduct...twice! What is going to happen at appeal and aren't the documents inadmissable because of lack of signatures? Hearsay? The non-conformance docs were from work that didn't pass customers inspections even though the shop(an Aviation Repair facility)was supposed to have a QC to inspect parts before they shipped. Most of time boss would say he was too busy to inspect parts and to just ship them.I believe that should place the added cost of repair squarely on his shoulders for not doing HIS job.HELP!

You will need to appear at the hearing. The hearing is the formal way for your emlpoyer to challenge your claim to benefits.
