Legal Question in Employment Law in Florida
Unemployment/disability Compensation
I have Fibromyalgia & lupus, My FMLA is about to end, my Dr. is recommending disability. Will I qualify for unemployment compensation while waiting for disability? I am single and will have no income. If not is there any other agency that will be able to help me pay my bills? Also I have been told by other people, not legally, that disability will turn me down the 1st 2 x's and will take approx 2 yrs to get, is this true to your knowledge?

Re: Unemployment/disability Compensation
The law provides that if you are not currently able and seeking full-time employment, then you are not eligible for unemployment compensation benefits. Accordingly, the strict answer to your question would be no. Additionally, there is no formula as to how insurance carriers and the gov't determines disability status, so there is no good answer as to what your carrier may do.
