Legal Question in Employment Law in Florida

unpaid comensation for work done

I was hired to work for a homecare agency as a I.V. and oncology nurse. I just recently discovered that I have been paid the wages of a regular nonspecality nurse. After telling my now supervisior my wage was increased $1.06. How do I recover the lost wages I should of been paid for the last 10 years!! I was required to go out at night and holidays when no-one else was expected to because I was the speciality nurse. I have continued to pay for my oncology certification an cont education. When I spoke to administation it was blown off as oh well. Please advise. By the way they are a huge hospital!!!

Re: unpaid comensation for work done

You would have to sue to recover the lost wages (if you have a union they might bring a grievance on your behalf), but it is not an open and shut case. You would basically make a contract argument. There is also a statute of limitations that will limit how far back you can go.

If there is overtime invloved, you might be able to recover for the past three years.

I would need more facts to advise how to proceed, but I think you need an attorney to negotiate with the hospital or possibly sue. I might be able to help, at least with negotiation, on a contingency basis (no attorney's fees unless there is a recovery) if you are interested. Please feel free to call for a free consultation.
