Legal Question in Employment Law in Florida
Unpaid for orientation and training
My daughter recently accepted a sales position and attended orientation and three days of classroom training. She was told these were paid. She was also told that she would be paid for 30 days additional on the job training. After working unusually long days for a month, she asked about her training pay. She was told because she did not work ALL 30 days of the month, she does not qualify. Her days started at 8:30 a.m. and ended after 10 p.m. most days! No one could work that kind of schedule! She has not been paid and I wish to know to whom I may report this slimy creep that hires unsuspecting young people and does not pay them! Furthermore, the owner of the company does not cut check unless the recipient attends morning meetings. He seems to be making requirements of independent contractors regarding receipt of their pay.

Re: Unpaid for orientation and training
She definitely is entitled to pay for the days she worked. Also, if she was an independent contractor, she may have a claim for triple damages under Florida law. Call the U.S. Dept. of Labor, wage and hour division to see if they will assist you. If you want to explore the triple damages aspect, you will need to contact an attorney or file a pro bono action.
