Legal Question in Employment Law in Florida
Can they withhold our pay as extortion
I work for a mortgage lender as a salary + commision mortgage banker. Our boss has just requested that we sign a form saying that if we resign or are fired that we will only receive a % of our base commission, not to include the bulk of the money we receive on our loans which is overage. All us commissioned employees feel this is unreasonable so we have thus far chosen not to sign. They have now emailed us that if we dont sign we will not receive our paychecks. Is this legal? And...do we have to sign this form knowing that if they choose to let us go at any given time we will be forfeiting the thousands of dollars we have in our loan pipeline????

Re: Can they withhold our pay as extortion
No, they cannot withhold your pay. All earned wages must, legally, be paid. However, if you refuse to sign, they could terminate your employment. Please contact me at (305) 810-2887 if you'd like to discuss how we might be able to assist you.
