Work Harrassment/Slander
I was fired after 5 years of working in the same office with no warning. I was told that I was being fired because no one in the office liked me anymore and that my office manager was getting rid of the things she hated and that included me. In those 5 years, I was harrassed by my office manager and the doctor i worked for about my weight, I was miserable. I was not paid overtime when I was there even when I worked it. After I filed for unemployment, I looked for jobs but found out that they were talking bad about me to future employers. They filed an appeal against me for my unemployment and won because she changed her story saying I was fired because I was on the internet constantly! I did use the internet but no more than anyone else and it was not an issue and we did not have a handbook stating that that was a rule. I feel totally taken advantage of and I keep getting kicked while I'm down. I have to pay back the umemployment money because they consider my behavior misconduct since she said i disobeyed her as far as the internet use. Do I have a case? Is it worth fighting for? Whether you have any cause of action in connection with your employment ending is very difficult to say because Florida is an at-will State. However, you should have a right to recover your overtime compensation, so you should consult with an attorney immediately and may contact us for further assistance as we handle cases throughout the State.
