Work and illness

My husband had slipped at work and hit his head and was knock unconcious. The guys at his job thought it was the funniest thing. He let his superiors know afterwards. A couple days later or so, he decided to go to the doctor because he was having painful headaches since the fall. He used my health insurance and was told that he is suffering from cluster headaches. I set an appointment up with a nuerologist and I faxed some of the papers he needed to his work addressed to him already filled out. His superior made a copy of the past and current problems marked off on sheet and then told my husband that before he came back to work on Monday, the doctor had to release him to do construction work. Can they do that?

Yes. If you think about it, although it is a pain, it protects both your husband and the employer. They have the right to make sure your husband will not hurt himself or others by returning to the job, especially construction where safety obviously is a big issue and someone could cause a lot of harm by blacking out, losing balance, etc. Also, it ensures for you and your husband that the doctor really is confident that there are no lingering problems to be addressed and it is safe to work.
