Legal Question in Employment Law in Florida

I'm working for a company that designates us as Multi-media Consultants and originally paid as Commission/Draw. We are now getting paid with Salary/Commission as of June 19th. Yet, we spend at least 20 of the 37.5 hours a week in the office and we are told repeatedly that we do paperwork in our Off Time and that we are not 8-5 reps. We are classified as Exempt Employees and sign e-timesheets with the hours listed only as 37.5 hours a week, 7.5 hours a day. Yet, I sometimes work longer hours during the day and even 3-4 hours at night. Am I entitled to Overtime and reclassified as Non-exempt?

Would have to go through more specific facts with you but it sounds like you should be nonexempt and paid overtime. Feel free to check out my employee rights blog at www.takethisjobnshoveitblog.com or my website www.behrenlaw.com for more information.
