Legal Question in Employment Law in Florida
I've been working for an insurance agency for 8 weeks. They agreed to pay me $1500 every 2 weeks. It was considered a "draw" on commissions. I was paid 4 times and then quit in the middle of a 2 week pay period. I was a 1099 employee and they didn't take anything out of my paycheck.
When I quit, I asked them to pay me for the week I was there in lieu of any future commissions. I had been bringing in plenty of business for their employee to process that they will eventually get paid commissions on, it just takes time.
They are refusing to pay me for my final week, calling it a draw on commissions, but I say they will eventually get the commissions.
Do they owe me for that final week, can I sue them for that?

You quit. They do not owe you a draw against future commissions. Depending on your contract, they may not even owe you the commissions.
