Legal Question in Employment Law in Florida

wronful termination of senior citizen

I had 6 1/2 years excellent work history with my company. I was let go for no apparent reason, rehired with raise and explanation that the owner was given false info on my job performance, then let go again when a young man was hired to replace me. Do I have legal recourse? I have lost necessary income and self esteem.

You have a potential case for discrimination based on age, though it is not an easy case to win. The process would require the filing of an action with the EEOC to allow them to do an investigation to determine if there is sufficient evidence to issue a Right to Sue Letter. This is a prerequisite for a discrimination case. After receiving this right to sue (which can take over a year sometimes), you can then file an action in state or federal court.

Back to your facts - if there was no mention of why you were fired and you were replaced by a younger person, it is likely there may be a potential case.

Best of luck.

Sincerely,

George Savage

A significant factor will be the age of the "young" man who replaced you and any other "legitimate business reasons" that your employer might be able to assert. I'd be interested in learning more about your case and would be happy to provide you with a consultation concerning the filing of your EEOC Charge and other legal rights. In this regard, please feel free to contact me at (305) 810-2887.
