Legal Question in Employment Law in Florida
wrongful termination
I feel I am being harassed by my boss who is the Human Resources manager and tried to fire me 2 years ago. I did complete a probationary time in Oct 06' where my work had improved and everything was fine, so I thought. However, she has not given up on terminating and documenting petty occurences to support her case. She talks about me in the workplace which undermines my credibility and has ruined some on my reputation. She ignores me but insists that I am the one to communicate with her, yet I get zero feedback. She undermines my work and has told me it is crap. She calls her boss ''spineless'' because he did not feel there was suffecient evidence to terminate me. She accused me of being unethical but had no proof, but still believes that it occured and won't let it go. We had a discussion last week where she yelled at me for a minor infraction that had nothing to do with my work and then went to the director to complain. I recently filed for FMLA that she was not happy with but is legimate and I have no intention of taking advantage. Today I have been asked to meet with him. Do I tell him everything or continue to not defend myself since I have done nothing wrong?

Re: wrongful termination
You shold follow any formal discrimination complaint procedure your employer has to ensure that you protect any additional claims you might have. Given that the HR manager is the problem, you may want to also consider who else in management you can go to since complaining to the harasser is not an option that as an exclusive avenue can be used.
