Legal Question in Employment Law in Florida
Wrongful and Unfair Dismissal
What is the time frame of filling a claim wrongful and unfair dismissal?
I was fired in February without any notice or write ups (as the company papers says). No 1 week notice, either. I had more than 3 months of an employment.
I read on Web by law, An employee is entitled to a minimum of 1 weeks' notice of dismissal if they have worked continuously for 1 month, but less than 2 years.
The reason of dismissal was ''You don't fit in the new image of the company.'' I think the employer did not have any fair reason to dismiss me like that right after my shift was over. I think this is wrongful and unfair dismissal.

Re: Wrongful and Unfair Dismissal
Unfortunately, the information you read on the Internet is incorrect. Florida is an "at will" employment State which regrettably means that an employer is allowed to terminate someone's employment for any reason at any time (which includes a good reason, a bad reason, or no reason at all). There is no notice requirement, so while it may have been unfair, based upon the facts provided, there does not appear to be any cause of action.
