RE: 3-Day Notice
We recieved a 3-Day Summons taped on our door on the 7th of Sept., and it was signed by a process server. I tried several times to phone the landlord to make the payment over the phone and they do not answer. I tried at least 5 times on the day the payment was due.......with no luck I faxed the information to the office stating they had my permission to run the charge along with the 3% service charge on the card the next morning at about 7:00am prior to their opening. Throughout the day I tried phoneing again to see if they got the fax. The payment should have been due on the 12th. Today I recieved papers from the court that was an Eviction Summons. In the package a totally different 3 day notice was included showing that the office manager personally served the notice to us on the 5th of September.....I do have the copy of the one placed on the door. The court preceeding's were started on the 11th, which is not accurate according to the 3-day notice on the door. Ever since we told them we would not make double lease payments to assist in the purchase of the property prior to the lease expiration they have been jerks.....they have even called my work and left negative comments with my co-workers. Is any of this legal?

You have 5 days from service to pay your rent into court or you will lose the case by default. Good luck.

You should hire a lawyer. Please contact my office we handle evictions.
