Legal Question in Landlord & Tenant Law in Florida
My 21 year old son was living with us for 9 months. We asked him to leave on many occasions, but he refuses. He takes drugs, steals from us and is verbally abusive. It was my understanding that since he was living with us for so long, our house was considered his legal residence and I would need to evict him. He recently went to jail and will be there for at least 6 weeks, possibly longer. Would he still be considered a legal resident of our home when he is released? If so, can I begin the eviction process now? I live in Broward County Florida.

You do not need formal eviction proceedings for your son if he is not a tenant and if he is not paying rent.
