Legal Question in Landlord & Tenant Law in Florida

I have a 19 yo son who is living with me and wont leave. he is stealing and stealing the car and his lisence is suspended. He has been asked to leave and laughs. He has no written agreement, renters paper etc and does not pay any money at all to the household. He is out of control. What steps do I have to take to have him removed from the premises by the police and not allowed to return. I am desperate. thanks

Start by calling the police. If they will not help, you will need to obtain a court order of protection.

You would likely need to file an ejectment action against him unless he has ever paid any kind of money on a periodic basis. If he has then you could evict. Seek legal help either way as this could explode and you may need a protection order or injunction to be entered at the same time as you file.

Under Florida Statue 82.091, you can file for Unlawful Detainer and sort of like an eviction and the same time periods, are used as on eviction, which will ultimately give you a writ of possession that will be served on your son by the Sheriff that will require him to move. Call our office or check with your local Clerk of the Court because often some County Clerks have pro se forms( forms you can file on your own), which the procedures to follow. Good Luck!
