Legal Question in Landlord & Tenant Law in Florida
Background check fee
The management of my apartment complex charges $100 to each tenant as a fee to have a background check run. I just recently paid it but feel as if it is not my responsibility to pay this fee. Is the $100 fee the responsibility of the tenant or management?

Re: Background check fee
If you were an existing tenant and there is no provision for this fee in the lease, you are not responsbile. If you were a new prosptective tenant, applying for a tenancy, they can charge whatever they want, as long as they told you in advance.
