Legal Question in Landlord & Tenant Law in Florida

If I had to break in to my home that i rent because i broke my key off in the lock at 2am because no one was home. can my landlord have me arrested, evicted, press charges or anything? he is trying to evict me and say he is going to have me arrested for property damage. I paid a $2200 security deposit for that didnt i? Not to mention, I fixed the door and the lock. He is trying to scare me and tell me i need to move out by saturday (3 days) or he will file all these papers. I am going through custody battle right now im a single father. I don't need any disturbances in that case, what should i do?

I want to stay. And I know i should have rights, right? The cops have never been called on me or my roommates, so i dont understand what ground he is evicting me on?

Your LL is just trying to scare you. As for the door, if you fixed it, then that is the end of it. If he is threatening to call the police (for what, I don't really know), tell him to go right ahead. If the LL wishes to evict you, he must file a proper eviction action in a court. The LL also must have grounds for the eviction (such as, you have broken terms of the lease). If you are complying with the terms of your lease, including paying rent, his eviction action is not likely to be successful.

As for the family law case, I don't really know how this case could affect the custody battle. Certainly, you need to have a place to live for your child. You should ask you family law attorney for advice regarding the custody battle.
