Legal Question in Landlord & Tenant Law in Florida

breaking a lease

My husband and I are in the process of buying a home. We are currently living at an apartment complex and our lease ends in may of next year. If we buy our house before then, is our apartment lease legally void? What steps do we have to take in order to end our lease without financial retribution or damage to our credit?

Re: breaking a lease

My suggestion is to consult an attorney to review your lease and recommend the best course of action. The purchase of a home will not void the lease, however your lease may provide you with some options. For example, does the lease permit subletting or does the lease have a clause permitting termination without penalty upon the purchase of a home? Other alternatives might be to negotiate down the breach penalty or to just pay the penalty if it is minor.
