Legal Question in Landlord & Tenant Law in Florida

I have a business lease in Florida. I had leased for one year and then went on a month to month basis. My landlord now tells me that I can either sign a new lease at one rate or continue going month to month at a higher rate. I decided to find another office to lease - my landlord requested a 60 days notice which I don't believe they had a right to more than 15 days but I am trying to keep it friendly so I agreed. My problem is that my rent was from the 10th of the month to the 10th. My sixty days fall end on the 21st of the month. They have my last month rent. They want me to pay them the full amount of rent for next month - this leaves a full month's rent for last month and I only will owe them for 11 days. What are my legal options? I am afraid they will keep the balance of the rent that is not owed to them.

They will likely keep the rent you pay. Pay what you believe is due based on your notice. Normally notice is calculated from first day of a month to the end and not from the specific date of notice. Since you have no written lease now the communications between the parties will control. Be prepared for a battle if they don't agree
