Legal Question in Landlord & Tenant Law in Florida

co-lease options

I lease a condo with another person and we've decided to no longer live together, I want to stay and she wants to stay. Is there any legal right either has over the other? If she decides it is best to leave can I legally hold her responsible for the remainder of her portion of the lease?

Re: co-lease options

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

If both of you are on the lease, you both have equal rights. I would strongly suggest that you both sit down, perhaps with a neutral third party, and try to resolve your issue.

If one does move based on a mutual decision, I do not believe that he or she should be responsible for payment of rent. This is an issue that should be discussed at the meeting above.
