Legal Question in Landlord & Tenant Law in Florida
WHO: Me and the company who rented me a condo for a week
WHAT: Rented house with my family from vacationrentals.com. On second night I stepped on a needle, wasn't a family member's or mine. With a little research, I found out it's used for administering glucose. Notified renter, they said he would send cleaning service. Nobody showed up until 8am the next morning. That morning, I contacted the renter and let them know I was leaving promptly. They said they couldn't discuss reimbursement until after the holidays. Looking to get my money back. I stepped on a NEEDLE!! Owner avoiding my calls and when we do speak he keeps telling me he will get back to me. I want my $1,018.50 back. Never been in this situation before, I don't want to start yelling lawyer, but this guy doesn't seem to want to give me the time of day.
HOW: How do I proceed? He sent the deposit check back with a written note that states that if I cash the check our business is done.
WHEN: December 26-29
WHERE: Deerfield Beach, Broward County, Florida

Your rental agreement, if written, would control. You need to have that reviewed. You don't necessarily have a right to reimbursement of your entire rental. If you do cash the security deposit check it sounds as if you will waive any further claims. Speak with an attorney with your paperwork before cashing the check.
Sounds like you may have a personal injury case. Why not pursue that after all who knows what was in that needle. Also if there is no meeting of the minds (a contract term) then cashing the check does not mean that you will not proceed against him.
Call a contract attorney for a consultation - most are free .
