Legal Question in Landlord & Tenant Law in Florida

Condo rent

Hello,

I am a foreign national who owns a condo in Florida. I would like to rent it out. Is it legal for me to collect rent $ from an American? I guess I would pay taxes on the rent $, but as a non US citizen and living in Europe am I allowed to do this?

Re: Condo rent

A foreign national may rent his property, but you must be careful in drafting the lease and paying the taxes because you must remit those to the state each year. The best solution is to contract with an attorney if Florida to draft the lease and to do a search on the tenant to make sure they are acceptable.

A foreign national can certainly rent out his/her condominium if it is allowed by the Association for any and all owners. Foreign nationals are not treated any differently than American citizens when it comes to leasing property.

I would check your condominium documents to make sure that renting or leasing is allowable. You may wish to retain an attorney to make sure your lease is properly drafted.
