Damaged computer and piano

My boyfriend and I rent an apartment on the third floor. A few days ago, a big amont of dirt for the plants was dumped in parking area front of our window without any notice. It was a bit odd but we didn't think too much of it. We didn't know they were moving all the dirt this morning so we came home this afternoon, all this thick layer of dirt was everywhere in our apartment including on the computer and piano. We called aprtment office but they were defensive and told us that it's our fault that we didn't close our window while we are work. Is this right?

I think it could go either way. I could see a judge saying you should have known better than to leave a window open near a pile of dirt that obviously would be moved at some point, and that you, at least, should have asked about the dirt. I can also see a judge saying that you should have been notified about when the dirt would be moved. There isn't any specific law on your question.

I don't know how much damage was done, but I'm not sure it's worth pursuing.
