Legal Question in Landlord & Tenant Law in Florida

Getting deposit back for vacation condo

I have put a deposit by personal check on a condo in Seista Key Fla. When calling to find out some infomation the phone was disconnected.I called the chamber who had them on there web site and they said they went bankrupt and are in foreclouser. Can I get my deposit back. Can I put a lean on the property so when it sells I get my money. How would I handle this?

If the company to whom you paid a deposit is in bankruptcy, then the only thing you can do is to file a "proof of claim" with the bankruptcy court. If they are not in bankruptcy, then you could file a small claims suit to recover your deposit. I can also suggest a person to contact if you're looking for another vacation rental in Siesta Key. Our office number is 5618640007.
