Legal Question in Landlord & Tenant Law in Florida

Hi, my name is Dina Georges and I've been a tenant in my new apt for about 3 months now. After my first month of living here, everything seemed perfect. Going into my second month, I began to notice a leak in my roof. The leak only occurs everytime it rains. I then brought it to his attention and he said he'd take a look at it from the outside. After that, the leak seem to have gotten worse. Never hearing from him again, I decided to give him a call and he said he'd come and take a look at it but never showed up. My boyfriend and I finally got him to come inside and take a look and he said he was in the process of fixing the problem. The real problem occurred when I came home from work and walked into the bathroom, or should I say a river.... There was water everywhere all coming from rain/storm that took place that day. This has now become a reoccurence and an inconvenience for us to have mutiple buckets, mops and towels to clean up the mess. We then agreed the next time it rained, we would call him in to see the disaster. And sure enough it rained about a week later and we called him over to witness the mess and he told me he'd come back early in the morning. The next day, I stayed home all day and he didnt show up. Once again causing an inconvenience for me. Up until today, my roof is still a hassel and thats only one of the many repairs I've brought to his attention. It has gotten to the point where he is completely ignoring me and avoiding all contact. I know this has to be a health and a safety violation and i need to know what can I do at this point.

You need to take your lease to a real estate attorney. It is likely that the landlord is obligated to keep the roof in a watertight condition. You may be able to withold rent, or break the lease if he is in breach of the contract. You will need to have notes, photos, facts and dates so that the attorney can build a reliable argument for you to either withold rent and/or move out.
