Eviction filed in different county

Our landlord has filed an eviction against us in Orange County Courts. The property we rent is in Seminole County, as well as their residence. Can Orange County Court handle a Seminole County Eviction?

I do not practice in that part of the state, but it is doubtful. I would call the Clerk of the Court's office and they will be able to tell you if the case was filed in the wrong court. If so, you can file a motion to dismiss which should be granted.

Keep in mind, that the landlord can then refile the case in the proper court. If you do not have a valid defense, you should make plans to find a new residence.
