Eviction

I just received an eviction summons because I did not pay my rent on time. The summons says that I have 5 working days to respond. I will have my full rent plus fees for Oct and regular rent for November in 2 days. Should I just make the payment to the rental office for November and take the Oct rent to the court or should I take it all to court? If I don't pay at all now, how many days will I get once I respond to the summons to move?

You can try to pay the rent to the landlord or their attorney. Unfortunately, more is owed now because your delay caused them to have to file suit which costs money. They do not have to take it over a month late and can refuse to accept it and just proceed to get a judgment.

If they do, and you have any valid defense, you can pay the money to the registry of the court. This will enable you to get a hearing but it will not avoid the payment of court costs, interest, late fees, and a reasonable attorney's fee if the landlord has engaged the services of an attorney.
